I. Role of Cozmo (The Platform)
Cozmo is an independent booking and retail platform and listing directory. We serve exclusively as a facilitator connecting users with independent, third-party service providers (e.g., salons, stylists) and product sellers (collectively, “Merchants”).
- No Ownership: Cozmo does not own or operate any physical outlets, stores, or salons listed on the platform.
- No Agency: Cozmo is not the agent, partner, or representative of any Merchant.
Availing services from Cozmo (as a customer), opening an Account, posting Services (as a service professional), and viewing posted Services are free of charge. The platform operator, Cozmo, reserves the right to change the fee structure. The decision to introduce these new fees is at Cozmo’s sole discretion.
Cozmo reserves the right to take action against properties or users who violate specific standards.
The grounds for removal or delisting are:
- Non-compliance with Cozmo’s policy.
- Violation of local law.
- Violation of national law.
Essentially, users and services must adhere to Cozmo’s rules as well as all applicable legal requirements to remain active on the platform.
II. Merchant Responsibility and Liability
The content, quality, pricing, and fulfilment of all services and products listed on the platform are the sole responsibility of the respective Merchant.
- Service & Product Issues: The individual service provider or seller on Cozmo is solely responsible and liable for any issues, disputes, damages, or claims arising from the services performed or the products offered, sold, or delivered by them.
- Warranties: For products covered by a manufacturer’s warranty, the user must refer the issue and any related complaints directly to the manufacturer for resolution.
- Offers: Our goal is to drive high football (traffic) to our merchants’ salons. By listing your salon on Cozmo, you agree to participate in the promotions, offers, vouchers, and discounts featured on our platform.
III. User Responsibility and Liability
By utilizing the Cozmo platform to browse listings, book services, or purchase products, the user agrees to the following responsibilities:
- Accuracy of Information: The user is responsible for ensuring that all personal information, contact details, and payment information provided during registration or checkout are accurate, complete, and current.
- Adherence to Merchant Policies: The user agrees to abide by the individual terms, policies (including cancellation and rescheduling rules), and instructions set forth by the respective Merchant for the service or product being purchased.
- Compliance with Laws: The user must use the Cozmo platform and its services in compliance with all applicable local, state, and national laws and regulations.
- Reviewing Service/Product Details: The user is responsible for carefully reviewing the service description, pricing, location, and any prerequisites or warnings provided by the Merchant before booking or purchasing.
- Assumption of Risk (Services): The user acknowledges that Cozmo is not responsible for the professional conduct, quality of service, or outcome of any service provided by a third-party Merchant (e.g., salon service, treatment). The user uses these services at their own risk.
- Dispute Resolution: In the event of a dispute regarding a service or product’s quality, fulfilment, or delivery, the user agrees to first attempt to resolve the issue directly with the responsible Merchant before escalating the matter through Cozmo (as Cozmo is not the primary liable party).
- Indemnification: The user agrees to indemnify and hold harmless Cozmo, its affiliates, directors, and employees from any claims, liabilities, costs, and expenses (including legal fees) arising from the user’s misuse of the platform or the user’s breach of these Terms.
